| Abstract: | This research analyzes gender-perspective adjudication and its application to labor court demands, particularly regarding inequalities in the labor market, gender discrimination, harassment and violence in the workplace, and occupational health and safety issues. It investigates how the jurisprudence of the Superior Labor Court (TST) has been positioning itself on the subject, especially following the incorporation of the guidelines set forth in the Protocol for Gender-Perspective Adjudication, published by the National Council of Justice (CNJ) in 2021, and the Protocol for Antidiscriminatory, Intersectional and Inclusive Action and Adjudication, published by the Superior Council of Labor Justice (CSJT) in 2024. The research first examines the main dilemmas faced by women workers and gender-based violence in the world of work, revisiting the epistemological foundations of Labor Law. It then analyzes how feminist theoretical frameworks, Anti Discrimination Law, and intersectionality as an analytical tool contribute to challenging exclusionary power structures and influencing the conduct of labor courts. A critical reflection is also developed on the role of Labor Justice in promoting access to justice, drawing on Nancy Fraser's three-dimensional theory of justice and the theory of the fundamental right to decent work. Methodologically, the research conducts quantitative and qualitative analysis of TST jurisprudence in order to assess the incorporation of the aforementioned protocols' guidelines into judicial reasoning. The findings indicate that, despite identifiable progress, the adoption of gender-perspective adjudication by the TST remains marked by superficiality and inconsistency: in a significant portion of decisions, the Protocols are referenced without their normative and methodological foundations being effectively integrated into legal argumentation. This scenario reveals that the shift in adjudicatory standards remains nascent and dependent on more robust institutional efforts to ensure that the formal commitment to gender equality translates into real protection of women's fundamental rights in the workplace. |
