Abstract: This dissertation analyzes the participation of civil society in the confrontation of the Brazilian State in the context of the development of the Policy on the Prevention and Combating of Torture in Brazil, taking into account three distinct historical moments: i) the National Permanent Campaign of Combat Torture and Impunity, that took place between 2001 and 2004; ii) the installation and first steps of the Nacional Committee for the Prevention and Combat of Torture (2014 to 2018), and; iii) the first period of the Nacional Committee after the dismantling of the participatory policies (2019 and 2020). The research presents, in its theoretical framework, a discussion on the main theoretical concepts present in the State and civil society relationship, seeking to outline and recover the role of civil society in the struggle for democracy in Brazil. It addresses the topic of torture as a constitutive dimension of the social issue in the country, since slavery, resulting from a historical process that reproduces itself with the passage of time as an instrument of social control and defense of the capitalist order. The theoretical reference of civil society in this research is supported by the Gramscian conception, which is associated with two basic elements: the enlarged conception of State and the concept of hegemony. The study was based on the hypothesis that the participation of civil society, in the early 2000s, was decisive in denouncing the current phenomenon of torture and demanding State actions to prevent and combat this crime in Brazil. But after the establishment of the System National for the Prevention and Combat of Torture, and the creation of institutions with the role of preventing and combating torture and other cruel, inhuman or degrading treatment or punishment, the demand for actions from the State and the list of demands from civil society was limited to the operation and scope of activity of these institutions. In this sense, it sought to understand the agendas presented by civil society, and the role of the State in the time frame of the research. The study was built through a qualitative research, aligned with the dialectical and historical materialist method, which understands the real as concrete totality. The methodological procedures involved data collection from primary sources and secondary databases; in addition to a permanent bibliographic review. From the analysis carried out, the research identified: the protagonism of civil society in the historic struggle against torture; signs of tapering on the agenda for the prevention and eradication of torture; without National Human Rights Conferences since 2015, and with the creation of the National System for Preventing and Combating Torture (law 12.847/2013) discussions and proposals that occur in the privileged locus of interaction between State and civil society are limited to the practices of torture in spaces of deprivation of liberty; with an ultra-right government that tries, through Decrees, to break the process of expanding participatory democracy, the problems for implementing the institutional arrangement of the policy begin to compete with the confrontation of the central issue: the fight against torture.
