| Abstract: | This research investigates the monitoring carried out by the Supreme Federal Court in structural proceedings, aiming to map how judicial monitoring has been conducted and the procedural instruments used by the Court. The research problem stems from the theoretical gap surrounding the lack of predetermined indicators for such monitoring by the STF. In the first chapter, the theoretical framework was based on criticisms of judicial action in structural proceedings, the importance of the monitoring stage, and the gap corresponding to the lack of objective parameters for its conduct. A parallel was drawn with indicators present in the public policy cycle, and instruments described by legal scholars as useful for monitoring the execution of judicial decisions were listed, including: public hearings; working groups; amicus curiae briefs; situation rooms; significant commitment; procedural scheduling; atypical evidence; sanctions for non-compliance and special masters—concepts that guided the empirical approach. The second chapter details the methodology used to construct the database, justifying the choices made for its formation, and then presents the empirical findings. To this end, a qualitative, descriptive approach was adopted, utilizing bibliographical and documentary research to cross-reference the data and provide the basis for the research. The ADPF procedural class and the lawsuits listed in previous empirical research were selected, resulting in 13 lawsuits for analysis. To facilitate understanding, the data collected were divided into seven thematic blocks: general data on the lawsuits; requests; court orders prior to approval of the action plan; technical meetings and public hearings; the action plan; amici curiae briefs; and the timeframe for processing. In the third and final chapter, the findings were problematized, revealing a dichotomy in the handling of cases by the Supreme Federal Court (STF). On the one hand, the court's efforts to evolve its application of monitoring techniques were noted, such as holding contextualization hearings in ADPF 635 and the novelty of determining significant commitment in ADPF 760. Conversely, there was no concern with basic premises that guarantee the effectiveness of the proceedings in some of the cases analyzed, as evidenced by the excessive detail of the precautionary measures granted in ADPF 976 and the absence of public hearings in ADPF 742. The empirical findings allow us to conclude that there is still no uniformity in the STF's handling of structural proceedings, requiring greater attention to the areas for improvement, described throughout the essay, to achieve a common procedural logic that allows for greater clarity and transparency. As a result of this work, a suggested checklist of standards to be observed in the STF's handling of structural proceedings, with a focus on the judicial monitoring phase, was developed. |
