Abstract:	This research analyzes the decisional patterns or trends of the Brazilian Supreme Court (STF) in modulating the effects of tax matters and the impacts of this decision-making technique on the distribution of cases at the first instance level. By surveying cases that had their effects modulated (ADI, ADO, ADC, ADPF, RE, ARE, and AI) through jurisprudence consultation using specific keywords (02/01/2025), the study reveals that the STF frequently modulated the effects on the merits, taking four to almost seven years to judge; adopted the publication date or the date of publication of the minutes of the judgment on the merits as the starting point for the effects; preserved pending actions up to a certain point by maintaining unconstitutional taxations, which, according to the literature, can stimulate rushes to the Judiciary; and exempted taxpayers from reimbursing the public treasury if they benefited from unconstitutional tax reductions. Based on the BNPR Consultation Panel and the procedural consultation systems of the courts researched, this study analyzes the distribution of first-instance cases linked to general repercussion issues that were processed until the end of 2024 and had their effects modulated. The results suggest the occurrence of judicial marathons: a large volume of cases distributed in the first instance between the day following the recognition of general repercussion and the eve of the start of the judgment of the selected issues, correlated with the delay of the STF in judging them. Additionally, they suggest the occurrence of speed races in the first instance when the Court, by attributing ex tunc effects to the unconstitutionality of taxation, guaranteed or seemed to guarantee the future deadline for filing actions that would be exempt from modulation. It is concluded that the STF needs to monitor, in a more transparent manner, the processing time of landmark cases and track the impacts of the modulations on the justice system through policies that improve statistical dashboards, such as those of the Open Court or the BNP Panel (successor to the former), and promote the continuous analysis of data.
