Abstract:	The present study proposes a discussion on the right to housing, seen from the perspective of the transformations on the right to property in Brazil. The general objective of this dissertation was to investigate how the legal forms that constitute the right to housing in Brazil have evolved over the 19th, 20th, and 21st centuries while being shaped by legal doctrine on property rights. With the adjunct of a deductive method, the study delves into the construction and debates surrounding the right to housing, drawing on Duncan Kennedy’s (2006) proposed phases of globalization of law and Western legal thought. It extensively explores pertinent Brazilian literature and analyzes formative historical, institutional, and social contexts. Furthermore, it conducts a comprehensive analysis of crucial legal milestones referencing the right to housing in Brazil. The dissertation is structured into three parts: firstly, it elucidates the right to housing as constructed from classical liberal legal doctrine; subsequently, it delves into the efforts made to overcome these shortcomings; and finally, it presents the current legal paths debated as means to the effective implementation of the right to housing. The findings reveal a persistent housing deficit and inadequacy in Brazil. From this perspective, the central argument of this dissertation is that the construction of the right to housing develops in various legal forms linked to three phases of globalization. The work concludes by indicating that achieving the effectiveness of the right to housing in Brazil still requires relevant reforms, notwithstanding the advancements reached so far.
