Abstract:	The urban land regularization of informal human settlements had its legal concept given by Federal law 11.977, dated July, 7, 2009, which established procedures and rules for the legal precedents, as well as solutions to the urban, environmental and social reorganization of the space, with the subsequent titularization for their occupants. However, the regularisation designed in a theoretical and a normative plan has many difficulties to materialize in a practice that effectively solve the situation of several informal segments who settled in the Federal District. Seeking to tackle the problem, the present work takes certain specific circumstances, from the perspective of a single case study, aiming to identify structural elements that are the cause of the phenomenon of informal occupations, as well as diagnose the obstacles for which the practices adopted by public actions fail to transpose satisfactorily this reality. Surely, once reached the conditions for overcoming, the settlement won't matter only in strictly formal submission of a given situation indeed in a situation of law; It will also be the reflection based on quality of life and principles of action in favor of the life of these populations generally excluded in the assessment of the social product, in such opportunities, the Welfare State acts not only to ensure real citizenship recipients, but also to carry out the constitutional desire of social equality as humanistic and democratic emanation. The analysis shows, however, the limitations that modern science – especially the science of law – has to deal with the complexity of contemporary conflicts. The judicial technique in its contentious method of sentencing, is not always able to give adequate responses to the conflicts formed by urban land demands submitted, circumstances which require new epistemological approach. That's because the social actors in conflict are separating constitutional rights whose harmonisation is beyond the limits of legal action for resolving conflicts woven natural, low complexity. Urban land conflicts are based on complex social, economic and political causes, in addition to requiring complex legal solutions in themselves. The interests of their respective groups interact in the same space and time, so that the full composition of the conflict will require accommodations to ensure the coexistence of the right of property in the entrechoque social housing law, without one of them assuming a position of primacy towards the other.
